WARRANTY

1. The warranty is in addition to (and does not exclude or modify in any way) any non-excluded statutory rights you may have (including under the Trade Practice Act).

TERM

2.The warranty runs for the term.

WARRANTY

3.subject to clause 4, we warrant that the Nditronics products will be free from inherent defects in materials and workmanship for the term.

4.The warrant ceases if:

a) The product ceases to carry the original manufacturer’s serial number or was sold at auction;

b) The product is repaired, serviced or interfered with (in any way) other than us;

c) the product is rented;

d) the product is damaged by:

· Normal wear and tear

· Accident

· Misuse

· Excessive use

· Incorrect voltage

· Use of non-specified accessories including recycled

· Failure to properly clean the product or any part (including heads, internal cavities, user accessible filters);

· Failure to properly maintain and service;

· Use of faulty or leaking batteries;

· Incomplete installation;

· Infestation by insects or vermin;

· Use of which is not design

e) The product is used in a commercial environment or used other than a normal, mobile phones).

5) This warrant does not cover service costs incurred through the installations of items listed as requiring periodic replacement..

6) This warrant does not apply to any accessory (including but not limited to cartridges aerials, styli, detachable power leads, earphones, toner, ribbons, connecting cables, batteries, and tape

CLAIM

7)If you wish to make a claim under the warranty you may contact us. The service will be in home service

if you request you send us the product you will do so.

LIABILITY

9) If we are in breach of the warranty, we will be liable to you for any loss or damage suffered by you by reason of the breach.

10) If you make a claim under warranty you will be fully compensated for your loss or damage by any of the following at discretion of Nditronics:

a) the payment of the cost of having the product repaired.

b) The replacement of the product or replacement by supply of similar product;

c) The repair of the product by authorized dealers or us.

d) The payment of the cost of having the product repaired.

11) If we provide you with either a replacement or similar product under clause 10 (b) or payment under clause 10(d) you immediately transfer ownership in the original product to us.

RETURN

12) If we take possession of the product under clause 7 or 8, and if we provide you with replacement or an equivalent product under clause 10(b), a repair under clause 10(c) or payment for repair under clause 10(d), we will return the replacement product , the equivalent product by delivering to you at our cost.

NOT COVERED

13) Subject to clause 1if, after we have inspected the product, we of the opinion that the product or alleged defect is not covered by the warranty for whatever reason, you will be liable for an
